Terms of Use
These Terms of Use (“Terms”) are an agreement between you and Thomas Marchozzi Financial Planning, Inc. (“we” or “us”), publisher of Tejo Blast (the “Game”, listed on Google Play under “Tejo Blast Games”). By downloading or playing the Game, or using tejoblast.com, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Game.
1. Who can play
The Game is suitable for players of all ages, including children under 13. Players under 13 get a kid-safe experience described in our Privacy Policy, with external links and purchases behind a parental gate. If you are under the age of majority where you live, you may use the Game only with the involvement of a parent or guardian, who agrees to these Terms on your behalf and is responsible for any purchases.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game on devices you own or control, for your own non-commercial entertainment. You may not copy, modify, reverse-engineer (except where the law allows), resell, or distribute the Game; use cheats, bots, or exploits; manipulate leaderboards; or use the Game in any unlawful way.
3. Virtual items and purchases
- The Game is free to play and offers optional in-app purchases, such as coin packs and a one-time “Remove Ads” purchase. Purchases are made through Google Play or the Apple App Store and are subject to their terms and payment policies.
- Coins and other virtual items have no real-world monetary value, cannot be exchanged for cash, and cannot be sold or transferred. You receive a limited license to use them in the Game, not ownership.
- Except as required by law or by the store’s refund policy, purchases are final and non-refundable. Refund requests are handled by Google or Apple.
- Because progress is saved on your device, coins and unlocked items that are not tied to a store purchase may be lost if you uninstall the Game, clear its data, or change devices. Non-consumable purchases such as “Remove Ads” can be restored through the store.
4. Ads and third-party services
The Game shows ads from Google AdMob and uses third-party services such as Google Play Billing, Apple StoreKit and Google Play Games Services. Your use of those services is also governed by their own terms and policies. We are not responsible for third-party ads, websites or services.
5. Leaderboards and conduct
If you use Google Play Games leaderboards, your gamer name and scores may be visible to others. Do not use offensive gamer names or cheat. We may remove scores that appear to be fraudulent.
6. Ownership
The Game, including its code, art, music, sound, text, characters and the “Tejo Blast” name and logo, is owned by us or our licensors and is protected by intellectual property laws. All rights not expressly granted are reserved.
7. Updates and availability
We may update, change, or discontinue the Game or any feature at any time. Some updates may be required to keep playing. We do not guarantee that the Game will always be available or error-free.
8. Disclaimer
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA OR PROGRESS, ARISING FROM YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH IN-APP PURCHASES IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. Some jurisdictions do not allow these limits, so they may not apply to you, and nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
10. Termination
You may stop using the Game at any time by uninstalling it. We may suspend or end your license if you break these Terms.
11. Apple App Store
If you downloaded the Game from the Apple App Store: these Terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support and, to the maximum extent permitted by law, no other warranty obligation for the Game; Apple is not responsible for addressing claims relating to the Game or for third-party intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use must also comply with Apple’s Usage Rules in the App Store Terms of Service.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise. Where permitted, disputes will be resolved in the state or federal courts located in Montgomery County, Pennsylvania.
13. Changes
We may update these Terms. The new version will be posted here with a new effective date. If you keep playing after changes take effect, you accept the updated Terms.
